Terms of Service

These Terms of Service ("Terms") govern your use of the AmarnathM74 Labs mobile application (the "App") and its associated backend services, operated by Amarnath Maddireddy under the name AmarnathM74 Labs ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Eligibility & Access

The App is available by invitation only. Accounts are created and provisioned solely by the administrator. There is no self-registration. By using the App, you represent that:

• You have been granted an account by the administrator.
• You are at least 13 years of age.
• You will use the App only for its intended purpose.

2. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Notifying us immediately at [email protected] if you suspect unauthorized access to your account.

We reserve the right to suspend or revoke your access at any time if we believe your account has been compromised or is being misused.

3. Acceptable Use

You agree to use the App only for its intended purpose of IoT device monitoring, energy measurement, and device control. You agree not to:

• Attempt to gain unauthorized access to the App, its servers, APIs, databases, or connected systems.
• Use the App to interfere with, disrupt, or damage any connected IoT devices, MQTT brokers, or network infrastructure.
• Reverse engineer, decompile, disassemble, or create derivative works from any part of the App.
• Probe, scan, or test the vulnerability of the App's systems without explicit written authorization.
• Share your account credentials with unauthorized individuals.
• Use the App for any illegal, harmful, or unauthorized purpose.
• Attempt to bypass, disable, or circumvent any security features or access controls.
• Inject malicious payloads, scripts, or commands through the App's MQTT or API interfaces.

4. IoT Device Interactions & Safety

The App allows you to monitor and control connected IoT devices, including but not limited to:

• Switching relays on and off (controlling electrical circuits)
• Modifying device operating modes and configuration parameters
• Triggering energy meter calibration procedures
• Performing hardware and software resets on connected devices
• Setting overcurrent protection thresholds
• Capturing electrical waveform data

You acknowledge and agree that:

• You are solely responsible for the physical installation, wiring, and safety of your IoT devices and any electrical systems they are connected to.
• Commands sent through the App directly affect physical hardware and electrical circuits. Improper use can result in equipment damage, electrical hazards, fire, or personal injury.
• The overcurrent protection feature is a software-based safeguard and should not be relied upon as the sole means of electrical protection. Proper hardware circuit breakers and safety devices must always be used.
• Calibration procedures should only be performed when you understand their effect on measurement accuracy.
• We are not responsible for any damage, injury, loss, or liability resulting from your use of the App's device control features, device malfunctions, firmware bugs, communication failures, or incorrect device configurations.
• All IoT devices are DIY hardware and are not certified consumer electronics. You use them at your own risk.

5. MQTT Broker Configuration

The App requires you to configure an EMQX MQTT broker to enable communication with your IoT devices. You are responsible for:

• The security and configuration of your EMQX broker instance.
• Safeguarding your broker API credentials (app ID and app secret).
• Any costs associated with your EMQX broker usage.

We transmit commands to your devices through your configured broker and receive telemetry data via webhook. We are not responsible for broker downtime, message delivery failures, or security breaches on your broker.

6. Energy Data & Measurement Accuracy

The App displays electrical measurements including voltage, current, power, energy consumption, power factor, frequency, and temperature readings from connected devices. You acknowledge that:

• All energy data is provided for informational and educational purposes only.
• Measurement accuracy depends on proper device calibration, wiring, sensor quality, and environmental conditions.
• We do not guarantee that energy readings, aggregations, analytics, projections, or summaries reflect exact real-world values.
• The App should not be used as the sole basis for billing, regulatory compliance, legal disputes, or critical energy management decisions.
• Waveform captures and derived electrical analysis (RMS, crest factor, power factor calculations) are computed from raw ADC samples and may contain measurement artifacts or inaccuracies.

7. Data Ownership & License

You retain ownership of your energy readings, telemetry data, device configurations, and any other data generated by your use of the App. By using the App, you grant us a limited license to store, process, and display your data solely for the purpose of providing the App's services to you.

8. Intellectual Property

The App, including its source code, design, user interface, logos, and documentation, is the intellectual property of AmarnathM74 Labs and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the App as intended.

9. Service Availability

We strive to keep the App operational, but we do not guarantee:

• Continuous, uninterrupted, or error-free operation of the App or its backend services.
• That the App will be compatible with all devices, operating systems, or network configurations.
• Timely delivery of MQTT commands to connected devices.
• That data will not be lost due to server failures, bugs, or other technical issues.

We may perform maintenance, updates, or modifications to the App at any time without prior notice.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE EXPRESSLY DISCLAIM ALL WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY ENERGY DATA, DEVICE TELEMETRY, OR ANALYTICS PROVIDED THROUGH THE APP.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMARNATHM74 LABS AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, energy readings, or device configurations
• Damage to IoT hardware, electrical systems, or connected appliances
• Personal injury or property damage resulting from device malfunctions
• Business losses, lost profits, or loss of business opportunities
• Costs of procurement of substitute services
• Any damages arising from unauthorized access to your account or data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless AmarnathM74 Labs and its operator from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your IoT devices, your violation of these Terms, or your violation of any applicable laws.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your API tokens will be revoked.
• You will lose access to all data stored on our servers.
• You may request a copy of your data before termination by contacting us.

Sections 4, 6, 10, 11, 12, and 14 shall survive any termination of these Terms.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If a resolution cannot be reached, the disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AmarnathM74 Labs regarding your use of the App.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
